Preamble

The Internet is an open, global network formed by the interconnection of computer networks using the TCP/IP protocol. Its management is not under the control of any central authority. Use of the Service implies full acceptance of these Terms and Conditions of Use.

1. Acceptance of the Terms and Conditions of Use

Docadoc provides its services on the condition that you agree to comply with these Terms and Conditions of Use (hereinafter "T&Cs"), which Docadoc reserves the right to modify at any time. The version currently in force is permanently available at: https://www.docadoc.com/conditions.php

The use of certain services may require compliance with additional rules set out in a charter available on the site, which forms an integral part of these T&Cs. Docadoc may also offer services subject to specific conditions, in which case these T&Cs shall not apply to those services.

2. Description of the Service

Docadoc provides its members with a range of online services designed for healthcare professionals, including: thematic discussion forums, electronic messaging between members, a document library (IcOdoc), a professional classified advertisements section, and other Docadoc-branded content and tools (collectively referred to as the "Service").

Any new feature that improves or supplements the existing Service is automatically subject to these T&Cs.

The Service is provided "as is". To use it, you must have access to the Internet and the necessary equipment, at your own expense.

With regard to the publication of messages and advertisements, you agree that the moderator may modify the section, topic, title or attachments of your submissions to improve readability, without prior notice. The moderator reserves the right to refuse any publication that does not comply with the applicable charter.

3. Registration requirements

By using the Service, you agree to provide true, accurate, current and complete information about yourself as requested during registration (the "Registration Data"), and to keep it up to date. If you provide false, inaccurate, outdated or incomplete information, Docadoc reserves the right to suspend or terminate your account and to refuse you access to all or part of the Service.

4. Categories of membership

Docadoc distinguishes between two membership statuses:

Standard member

Registration as a standard member is free of charge.

Standard members have access to a portion of the Service defined by their professional status. During the first 60 days following initial registration, standard members enjoy the same access as Premium members, with the exception of the ability to post a classified advertisement and access to the discussion search engine.

Premium member

Premium membership is charged at 49 € incl. VAT per year, and does not renew automatically.

Premium members have access to all features available to their professional status, including:

Access to the discussion search engine, which allows searching through the forum discussion archives. This is distinct from the IcOdoc document library search engine, which is accessible to all members.
A free classified advertisement credit of one advertisement per current annual subscription period (see Article 6).

Upon first registration, Premium members receive an additional 60 days free of charge. If a member upgrades to Premium before this free period expires, the remaining days are added to the first Premium subscription period.

Upon expiry of the subscription, if not renewed, the member loses Premium status and its associated benefits, and reverts to standard member status.

Guest reader

Any member may apply for access, as a "guest reader", to discussions not open to their specialty. The request is subject to the moderator's discretion, who may accept or refuse it without being required to provide a reason. A guest reader may not initiate a new message; only contributions to existing messages are permitted.

5. Premium subscription

The Premium subscription fee is set at 49 € incl. VAT per year.

Three payment methods are accepted: credit or debit card (including Google Pay and Apple Pay), bank cheque, and bank transfer. Payments are accepted in euros only. Your invoice is available at any time in your member account. No invoice will be sent by post.

6. Classified advertisements

The publication of classified advertisements is open to all members, both standard and Premium, subject to compliance with these conditions.

Publication rules

All advertisements must be published by their author, in their own name. Publication of advertisements on behalf of third parties is prohibited, except where express written authorisation has been granted upon request to: info@docadoc.com.

Advertisements for paid events. The direct publication of advertisements for training courses, conferences or any event requiring a paid registration is not permitted for members, regardless of their membership category. Such advertisements fall under the sponsored advertisements scheme, reserved for organising entities. These entities are invited to contact Docadoc at: info@docadoc.com.

The free advertisement credit granted to Premium members is limited to one advertisement per annual subscription period. It cannot be carried over from one year to the next and is not refundable if unused.

Display duration

Advertisements are displayed online for one (1) month from the date of publication.

Requests for exceptional free publication

Any member may request free publication of an advertisement by providing a written justification when composing the advertisement, using the form provided for this purpose. Such requests are subject to the sole discretion of the moderator or administrator, who reserves the right to refuse without being required to provide a reason, as such free publication constitutes a departure from these conditions.

Liability

The member is solely responsible for the content of their advertisement. Docadoc cannot be held liable for any transactions, exchanges or disputes arising between members following the viewing of an advertisement.

Invoicing

Any online payment for an advertisement gives rise to the issuance of an invoice. This invoice is available at any time in your member account. No invoice will be sent by post.

7. Newsletter and electronic communications

Docadoc may send its members a periodic newsletter of an informative and professional nature. Any member may unsubscribe from this newsletter at any time by clicking the unsubscribe link included in each mailing, or from their preferences in their member account.

Deactivating the newsletter does not affect other Service-related communications (discussion alerts, advertisements, private messages), which are managed through separate settings in the member account.

8. Privacy policy

In accordance with French Law no. 78-17 of 6 January 1978 on data processing, files and civil liberties, and the General Data Protection Regulation (GDPR), you have the right to access, rectify, obtain portability of, and request erasure of your personal data. The database of Registration Data has been declared to the CNIL (no. 819849038).

Docadoc reserves the right to use collected IP addresses to identify users when required by a competent judicial or administrative authority, or to enforce these T&Cs. In this context, IP addresses may be transmitted to internet service providers or relevant authorities.

9. Account, password and security

Upon completion of the registration process, you will receive login credentials. You are solely responsible for maintaining their confidentiality and for all actions carried out under your account. You agree to notify Docadoc immediately of any unauthorised use and to log out explicitly at the end of each session.

Confidentiality of electronic messages received from the platform. Electronic messages sent by Docadoc to its members (discussion emails, new advertisement notifications, newsletters, private message alerts, or any other electronic message sent by the platform) contain personalised automatic login links. By clicking on one of these links, any person in possession of the message is recognised by the platform as the intended member and gains access to their account without entering a password, including access to the personal member area.

The member is solely responsible for the confidentiality of their electronic messages. Any forwarding, even partial, of an electronic message received from Docadoc to a third party may enable that third party to freely access the member's account and act on their behalf on the platform. Docadoc cannot be held liable for the consequences of such access.

10. Member conduct

You are solely responsible for any Content (messages, documents, images, videos, or any other material) that you publish or transmit via the Service. Docadoc does not exercise editorial control over such Content and cannot be held liable for its illegal, inaccurate or inappropriate nature.

You are prohibited from:

Publishing or transmitting any Content that is illegal, defamatory, threatening, hateful, obscene, or that infringes the privacy of others.
Accessing or distributing any Content that is contrary to applicable French law.
Causing harm of any kind to minor users.
Transmitting any Content inciting discrimination, hatred or violence, or glorifying crimes against humanity or acts of terrorism.
Impersonating another user, employee, moderator or representative of Docadoc.
Concealing the origin of any Content transmitted via the Service.
Disclosing confidential information obtained in a professional or contractual context, without authorisation.
Publishing any Content that infringes intellectual or industrial property rights.
Sending unsolicited communications (spam, chain messages, unauthorised advertising, etc.).
Introducing viruses or any malicious code capable of affecting the Service or other users' equipment.
Disrupting the proper functioning of the Service or any networks connected to it.
Violating any applicable national or international law or regulation.
Harassing other users in any way.
Collecting or storing personal data relating to other members without their consent.

Docadoc reserves the right, at its sole discretion, to remove any Content that is contrary to these T&Cs or applicable regulations, without prior notice.

Private messaging. The Service includes a private messaging feature between members. The member is solely responsible for the content of messages sent through it. The same rules of conduct that apply to public discussions apply to private messaging. Docadoc does not guarantee the absolute confidentiality of these exchanges and reserves the right to access them in the cases set out in Article 9 of these T&Cs.

11. Medical liability and translations

Opinions expressed in Docadoc discussions are provided for information and educational purposes only. Only the healthcare professional receiving the information is in a position to adapt it to their patient's clinical situation. In this context, any opinion is given under the sole responsibility of the healthcare professional who receives and applies it.

Automatic translations. Content on the Service (discussions, IcOdoc documents, advertisements) may be automatically translated for indicative purposes only. Docadoc does not guarantee the accuracy of these translations and accepts no liability for their use, particularly in a clinical context. In case of doubt, the original version of the message shall prevail.

12. Sharing of IcOdoc folders

The Service allows members to share an IcOdoc document folder with third parties via a link. The member is solely responsible for the distribution of this link and the persons to whom it is transmitted. Docadoc cannot be held liable for any unauthorised access resulting from the member transmitting the link to an unintended recipient.

13. Indemnification

You agree to defend, indemnify and hold harmless Docadoc, its affiliated companies, representatives, employees and partners against any damage, claim or demand from third parties arising from your use of the Service, the publication of Content, or the violation of these T&Cs or the rights of others. This indemnification covers damages awarded, reasonable legal fees and court costs.

14. Prohibition on resale of the Service

You are prohibited from reproducing, copying, selling, reselling or exploiting for any commercial purpose any part of the Service, its content or the access rights granted to you.

15. General rules on use and storage

Docadoc reserves the right to establish limits on the use of the Service (maximum message retention periods, data volumes, access frequency, etc.) and to modify them at any time. Docadoc does not guarantee the preservation of any message or Content transmitted via the Service and reserves the right to delete any account that has remained inactive for an extended period.

16. Modification of the Service

Docadoc reserves the right to modify, temporarily or permanently suspend, or discontinue all or part of the Service, without prior notice. Docadoc shall not be liable to you or any third party for any such modification, suspension or discontinuation.

17. Termination

Docadoc may, at any time and for any reason, suspend or delete your account and your access to the Service, in particular in the event of a breach of these T&Cs, without prior formal notice. Docadoc shall not be liable for the consequences of such termination.

18. Hyperlinks

The Service may contain links to third-party websites. Docadoc has no control over these sites and shall not be liable for their content, products or services, nor for any damage that may result from their use.

19. Docadoc's intellectual property

The Service and associated software are protected by intellectual property law. The Docadoc trademarks and logo are registered trademarks. Any reproduction, use or distribution without express authorisation is prohibited.

Docadoc grants you a personal, non-exclusive and non-transferable right to use the Service in accordance with these T&Cs. Any other use is expressly prohibited.

20. Reporting intellectual property infringements

If you believe that a work belonging to you has been reproduced without authorisation on the Service, you may notify Docadoc by providing the following:

The electronic or physical signature of the rights holder or their authorised representative.
A description of the work you consider to have been infringed.
The location of the allegedly infringing material on the site.
Your full contact details (address, telephone number, electronic mail address).
A declaration in good faith that the use of the material has not been authorised by the rights holder or their representative.
A declaration, made under penalty of perjury, that the information provided is accurate and that you are the rights holder or are authorised to act on their behalf.

21. Warranties

The Service is provided "as is" and subject to availability. Docadoc does not warrant that the Service will meet your expectations, be free from errors, or be available without interruption. Results obtained through the Service are not guaranteed to be accurate or reliable. Any download is carried out at your own risk.

22. Limitation of liability

To the fullest extent permitted by applicable law, Docadoc shall not be liable for any direct or indirect damage (including loss of profits, data, goodwill or any other intangible loss) arising from the use of or inability to use the Service, from unauthorised access, or from any other event connected to the Service.

23. Notices

Any notice may be sent to you by electronic mail or by post. Docadoc reserves the right to modify these T&Cs by posting a notice of change directly on the Service.

24. General provisions

These T&Cs constitute the entire agreement between Docadoc and the user and supersede any prior agreement. Failure by Docadoc to exercise any right provided for herein shall not constitute a waiver of that right. Should any provision be declared void by a court of law, the remaining provisions shall continue to apply between the parties.

These T&Cs are governed by French law. Any dispute shall be submitted to the competent courts of Paris.
